Contract — Negligence – Independent duty of due care 

Where a plaintiff has filed a motion for reconsideration of a court order that dismissed a count alleging negligence, the motion should be denied despite the plaintiff’s claim that it was error not to apply the rule in Baranowski v. Strating, 72 Mich App 548 (1976).
